Terms & Conditions

Last Updated: October 2026

1. APPLICATION OF TERMS

1.1. These Terms and Conditions apply to all call-outs, diagnostic visits, repairs, installations, routine maintenance, remedial works, and supply of parts provided by Electric Gates Experts Limited (Company No: SC872826, Registered Office: Unit 3, Westerton Farm, Killearn, Glasgow, G63 9LE)  to any commercial or residential client.

1.2. By booking a call-out, issuing a purchase order, accepting an estimate, or approving a quotation provided by the Company, the Client unconditionally agrees to be bound by these Terms to the exclusion of any other terms or conditions.

2. CALL-OUTS, DIAGNOSTICS, AND HOURLY BILLING RULES

2.1. Initial Call-Out Charge: All emergency or scheduled call-out attendances are subject to an initial call-out fee of £150.00 + VAT. This fee covers travel costs and includes up to the first 60 minutes (1 hour) of site attendance for diagnostic assessment, fault-finding, or immediate repair.

2.2. Full-Hour Billing Increments:

  • Site attendance time is calculated and charged strictly in full 1-hour increments.

  • Once site attendance exceeds the initial 60 minutes (i.e., upon entering minute 61), the second full hour becomes immediately chargeable at £75.00 + VAT.

  • Every subsequent hour or part-hour entered after the initial call-out period is charged at £75.00 + VAT per hour.

  • Partial hours, half-hours, or fractions of an hour are billed as full 1-hour intervals and are strictly non-pro-rated.

2.3. No Guarantee of Permanent Fix: A call-out visit covers investigative fault-finding and immediate repair attempts where feasible on site. A call-out fee does not guarantee a completed repair. If additional replacement parts, specialised equipment, or extended remedial works are required, the engineer will isolate the issue and provide a quotation for the next steps to resolve the fault. The initial call-out fee remains fully payable regardless of whether a full repair was achieved during that visit.

3. QUOTED REMEDIAL WORKS, LABOR, AND MATERIALS

3.1. Labour Rates & Increments: Quoted repairs, remedial works, and installation labour are charged at a rate of £75.00 + VAT per hour, sold exclusively in block increments of 4.5 hours (half-day) or 9.0 hours (full-day).

3.2. Materials & Hardware Markup: All supplied parts, replacement hardware, safety devices, electronic control units, and materials are subject to a 20% trade markup applied to supplier cost prices.

3.3. Validity: Written quotations issued by the Company remain valid for 30 calendar days from the date of issue unless stated otherwise in writing.

4. ROUTINE GATE SERVICING

4.1. Service Fixed Packages: Routine preventative maintenance plans are charged at the following fixed rates:

  • Bronze Service: £350.00 + VAT

  • Silver Service: £400.00 + VAT

  • Gold Service: £600.00 + VAT

4.2. Purpose & Scope: Gate servicing acts as a preventative maintenance and health check (analogous to a vehicle MOT test) designed to inspect, adjust, clean, lubricate, and test electrical connections, safety devices, and mechanical moving parts of an automated gate system.

4.3. Exclusions: A routine gate service does not:

  • Extend or grant any new warranty on existing automation equipment or components.

  • Include the cost of replacement parts, hardware, or structural repair work required to fix identified defects.

  • Guarantee immunity against future operational faults or wear and tear.

5. SITE ACCESS, DELAYS, AND CANCELLATION FEES

5.1. Site Access Obligations: The Client must ensure safe, clear, and unhindered access to the gate system, electrical power isolation points, intercoms, and access control housing upon the engineer's arrival.

5.2. On-Site Delays: Any delays on site resulting from restricted physical or electrical access, uncoordinated third-party contractors, or key/code unavailability will be charged at our standard rate of £75.00 + VAT per hour.

5.3. Cancellations & Aborted Visits:

  • Cancellations made with less than 24 hours' notice prior to the agreed booking window will incur a cancellation fee of £100.00 + VAT.

  • If an engineer arrives on site and cannot gain access within 15 minutes, the booking will be classified as an aborted visit and billed at £100.00 + VAT.

6. PAYMENT TERMS, OVERDUE ACCOUNTS, AND TITLE RETENTION

6.1. Payment Due Dates:

  • Call-outs & Emergency Attendances: Payment is due immediately upon completion of site attendance.

  • Quoted Works & Servicing: Payment is due strictly upon completion or according to the payment terms specified on the tax invoice.

6.2. Retention of Title: Title and legal ownership of all parts, materials, and automation hardware supplied shall remain with Electric Gates Experts Limited until all associated invoices are paid in full. The Company reserves the right to repossess or deactivate unpaid equipment where lawful to do so.

6.3. Late Payment Interest:

  • Commercial Accounts: Late payments will incur statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998 at 8% above the Bank of England base rate, alongside fixed administrative recovery costs.

  • Consumer Accounts: Overdue residential payments will accrue interest at 4% above the Bank of England base rate from the due date until full payment is received.

7. LIMITATION OF LIABILITY & SYSTEM SAFETY

7.1. Pre-Existing Defects: The Company accepts no liability for pre-existing electrical, mechanical, or structural defects, adverse weather damage, pest infestation, or power surges affecting automated gate systems.

7.2. Safety Regulations: If an automated gate system is assessed as dangerous or non-compliant under relevant UK safety standards (e.g., BS EN 12453), the Company reserves the right to isolate the power supply to ensure site safety. The system will only be recommissioned once the safety deficiencies have been fully rectified.

7.3. Liability Cap: To the fullest extent permitted by law, the total liability of Electric Gates Experts Limited for any claim arising out of services provided shall not exceed the value of the invoice issued for those specific services.

8. GOVERNING LAW

These Terms and Conditions shall be governed by, construed, and enforced in accordance with Scots Law. The Scottish courts shall have exclusive jurisdiction over any legal disputes.
